General conditions of sale of Grottes du Cerdon
GENERAL TERMS AND CONDITIONS OF SALE FOR INDIVIDUAL TICKETS
All orders or reservations imply unreserved acceptance of these general terms and conditions of sale, unless otherwise expressly agreed to in writing by Sarl TELLUS, trading as Grottes du Cerdon.
Each visitor must comply with the Internal Regulations or the notices posted on the Grottes du Cerdon site, located at the entrance to the site, in the Park, at the entrance to the Caves, and in the Cave Gallery.
1. ORDER
Article 1-1: Ordering an Individual Ticket
The details of the offers available from the GROTTES DU CERDON Prehistoric Leisure Park can be found on the “Ticketing” page of the website www.grotte-cerdon.com.
Article 1-2: Effect of the Order
The order is firm and final for the customer, who may only cancel or modify it under the conditions stipulated in these general terms and conditions of sale. This booking is final and binding for the CERDON CAVE Prehistoric Leisure Park after confirmation at the cash register in the visitor center or upon receipt of the ticket confirmation email to the address provided during the online booking process.
2. PRICES
When the price is based on the children’s age, it is calculated from the first day of the activity. Proof of age may be requested at any time by the staff of the CERDON CAVE Prehistoric Leisure Park. If such proof is not provided, the adult price will apply.
Article 2-1
Orders at the visitor center: Payment is made at the time of booking by credit card, cash, or cultural voucher as specified on our “Ticketing” page.
Online ordering: Payment is made by credit card at the time of ordering, using the secure procedure provided for this purpose on the GROTTES DU CERDON Prehistoric Leisure Park website.
For this online ticketing service, the GROTTES DU CERDON Prehistoric Leisure Park website uses an external provider: GUIDAP.
3. CONDITIONS OF SERVICE
Orders placed at the site’s reception desk grant immediate access to the park for the same day: the ticket cannot be used for a later date without written consent from the site’s reception manager.
Online orders:
1/ Tickets for Guided Tour of the Caves, Self-Guided Tour of the Caves, Guided Tour and Activities Day Pass, Self-Guided Tour Day Pass, and Storytelling Tour Day Pass can only be used for the day selected at the time of ordering. The park’s opening dates can be found on the website www.grotte-cerdon.com.
The time chosen when booking the guided tour can be changed on the same day depending on availability or replaced with a self-guided tour (maximum 8 people at a time).
The aforementioned tickets are non-refundable if they have not been used on the scheduled dates. However, upon request by email, it is possible to transfer them to another day during the season.
Insurance is offered by the Grottes du Cerdon website to ensure a full refund. This insurance covers the processing time of the request as well as the costs associated with the refund.
In the event of an administrative closure of the site (e.g., COVID-19), tickets are extended for a period of 18 months.
The Annual Pass can be used on any day the park is open during the season indicated on the ticket. This pass is valid for one year from the date of purchase. It can therefore be used across two seasons. The park’s opening dates can be found on the website www.grotte-cerdon.com.
This ticket is non-refundable if not used on the scheduled dates.
The Gift Voucher can be used on any day the park is open during the season indicated on the ticket. The park’s opening dates can be found on the website www.grotte-cerdon.com.
This ticket is non-refundable if not used during the scheduled season unless insurance was purchased at the time of purchase.
The Arc’Aïk Battle ticket can only be issued for a minimum of 10 adults. A player’s liability waiver is required before the game.
This ticket is non-refundable if not used on the scheduled dates. It may be rescheduled for a later date with the agreement of the site’s reception staff.
The caving ticket is not managed by the Cerdon Caves ticket office. The Cerdon Caves use a state-approved provider to supervise caving activities on our site.
The fee for this ticket or service must be paid to Mr. Yves Contet, the caving organizer at the Cerdon Caves.
The disabled and large family discount of 10% applies exclusively to purchases made directly at the park entrance and for the same day. This discount is applicable under the following conditions:
Disabled discount: Presentation of a disability card (cannot be combined with any other offer)
Large family discount applies to the same family with large family cards for each family member or with proof of health insurance coverage for children under the same name as the parents. This discount applies to groups of 2 or more parents and 3 or more paying children (cannot be combined with any other offer)
4. COMPLAINTS
All complaints must be sent by email to info@grotte-cerdon.com (within 2 days of the visit) or by registered mail with return receipt requested no later than 8 days after the visit.
5. MODIFICATION OR CANCELLATION BY GROTTES DU CERDON
Management reserves the right to modify or cancel any reservation in the event of force majeure, unforeseen circumstances, or specific operational constraints. In the event of cancellation of a service by GROTTES DU CERDON, the amount paid by the client will be fully refunded, excluding any other compensation.
6. RIGHT OF WITHDRAWAL
Pursuant to Article L221-28 of the French Consumer Code, the services covered by these general terms and conditions of sale are not subject to the right of withdrawal stipulated in Article L221-18 of the French Consumer Code.
7. LIABILITY
GROTTES DU CERDON shall not be held liable under any circumstances for non-performance or improper performance of the order attributable to the client or to the unforeseeable and insurmountable actions of a third party.
8. FORCE MAJEURE
Force majeure is defined in Article 1218 of the French Civil Code: Force majeure exists in contractual matters when an event beyond the debtor’s control, which could not reasonably have been foreseen at the time the contract was entered into and whose effects cannot be avoided by appropriate measures, prevents the debtor from performing their obligation.
If the impediment is temporary, performance of the obligation is suspended unless the resulting delay justifies termination of the contract. If the impediment is permanent, the contract is automatically terminated and the parties are released from their obligations under the conditions set forth in Articles 1351 and 1351-1 of the French Civil Code.
In addition to the elements typically recognized by French case law as constituting force majeure, the obligations of GROTTES DU CERDON are automatically suspended without the company being held liable for any non-performance in the event of force majeure and, more generally, in the event of any event beyond its control preventing the normal execution of the order, such as: severe weather, flooding, fire, strikes or lockouts at GROTTES DU CERDON or its suppliers, supply difficulties, decisions by administrative authorities, riots, vandalism, equipment failures, blockages or delays in transportation, force majeure affecting suppliers, or any other cause leading to partial or total work stoppage for GROTTES DU CERDON or its suppliers.
The management of GROTTES DU CERDON will inform the client of the occurrence of such an event by mail or email as soon as it becomes aware of it, specifying the services concerned.
9: PERSONAL DATA
In accordance with legal provisions, customers have the right to access, rectify, and object to their personal data. This right can be exercised by writing to the seller, specifying their surname, first name, and address. Subject to the customer’s consent at the time of ordering, this personal data is processed electronically to provide the customer with information about the seller’s services and offers.
10: DISPUTES
These general terms and conditions of sale are governed by French law, both in their interpretation and implementation, and fall under the jurisdiction of the District Court of Bourg-en-Bresse.
